When an Injury Becomes a Legal Claim

Accidents on the road or at the workplace can cause injuries that involve substantial expenses and legal concerns. According to NHTSA statistics, U.S. traffic deaths were projected to total 36,640 in 2025, a 6.7% decline from 2024. In addition, there were approximately 2,488,400 nonfatal workplace injury and illness cases in private industry in 2024, according to the Bureau of Labor Statistics.

In case when injury is caused by the negligence or wrongful act of another party, one can make claims and obtain compensation for the loss incurred. But what is personal injury? And when does it become a legal claim?

Whether an injury supports a claim depends on the circumstances, applicable law, evidence of liability, and the damages suffered. Letโ€™s look at how this case works.

Someone Else Has to Have Owed You Something

The basis of legal accountability lies in the fulfillment of duties. The duty is determined not by the consequences but by the relationship between individuals and the surrounding context. A driver has a duty to exercise reasonable care toward others on the road.

A property owner owes a duty to visitors that changes according to the reason for their visit. A manufacturer is responsible for the product he produces.

Where no such relationship exists, an injury stays an injury. Slipping on oneโ€™s own steps, falling from the trail while hiking, or an injury incurred during a sport in which everyone has agreed to participate. Injury and liability are two different issues, and so the law maintains the distinction.

The Injury Has to Be Provable, Not Just Real

Condition two is the evidentiary one. A case has to have documentation of the event leading to the injury, and that gets assembled largely by accident in the early weeks through people who are not considering litigation.

Three problems destroy it. The passage of time between the event and the first medical visit creates a period where an insurance company can say that it did not happen at all.

Inconsistent treatment, treatment starting and stopping, suggests recovery from one thing followed by another problem. And a pre-existing condition in the same part of the body, which turns every later record into an argument about what is new.

None of those ends a case on its own. Bartlett & Grippe, LLC, works from Cheshire and Waterbury across eight Connecticut counties, and the personal injury lawyers from Bartlett & Grippe, LLC, list among their results a $200,000 settlement for a driver rear-ended on I-91 who had prior back injuries.

Work Injuries Go Through a Different Door

There were 2.5 million non-fatal work-related injuries and illnesses at private companies in 2024. This marks a decline of 3.1 percent compared to the previous year, and the incidence rate of 2.3 cases per 100 full-time workers was the lowest recorded since 2003.

Very few of those turn into personal injury lawsuits, and that reflects design rather than failure. Workers’ compensation operates as the exclusive remedy against an employer, trading proof of fault for a faster and more limited recovery. A claim against someone other than the employer, a contractor on the same site or the maker of a machine, runs on the ordinary rules instead.

The practical effect is that one injury can produce one claim, two claims, or none, depending entirely on who caused it.

The Clock Runs Whether or Not Anyone Has Decided

Timing is the final requirement, and it happens unseen. Periods of filing begin from the time the injury happened or a reasonable person would have become aware of it, not from deciding to do something. Waiting a year may have one year less to file a claim.

Deadlines for claims against a city, a county, or a state agency usually run much shorter and on a separate schedule. Those can close entirely while the ordinary period still has years left on it.

CDC data shows about 43.5 million injury-related emergency department visits in 2022, and many of them involve no one elseโ€™s legal responsibility at all. That is not a defect in the system. It is roughly what the system is for, since the alternative would make every unlucky afternoon somebody’s fault.

The useful question after an injury is not how much it hurt. It is whether anyone owed you something and whether the record can still show it.
